NEW DELHI: Supreme Court on Wednesday agreed to hear an application by Centre seeking the annulment of the appointment of Tadasha Mishra as Jharkhand DGP on the ground that it was in violation of procedures laid down in SC’s 2006 Prakash Singh judgement.Arguing that the appointments of the last two DGPs were also illegal, Centre said Mishra was appointed the state’s police chief just a day before she was to retire, which was in conflict with the SC order that disapproved the practice among states to appoint DGPs on the last date of their tenure so that the person remained in the crucial position for two more years.SC had also clarified that the officers who are empanelled by the state, as far as practicable, must have two years of service left. Solicitor general Tushar Mehta said though an application on the matter was filed more than a month ago, it had not yet been listed for hearing. A bench headed by CJI Surya Kant directed it to be listed for Thursday.Centre questioned the legality of Jharkhand’s ‘Selection and Appointment of DGP (Head of Police Force) Regulation, 2025 and said the regulations are ex-facie violative of various SC directives, especially its ruling that a state could pick DGP from among those on a panel prepared by UPSC.

A petition challenging the validity of the 2025 regulations was transferred from Jharkhand HC to SC in Aug last year. Jharkhand govt appointed Mishra as DGP on Dec 30 last year after amending its own 2025 regulations, which too mandated six months residual service prior to superannuation. MHA had written to Jharkhand to cancel the appointment and take steps to appoint a new DGP.
